Pretoria Magistrate Court Violates “Khekhe” Rights

Vusi “Khekhe” Mathibela is currently waiting on judgement after he abandoned bail – Lawyer convinced High Court his arrest was violating his rights.

Vusi “Khekhe” Mathibela’s lawyer arrived at the Palace of Justice in Pretoria on Friday after he convinced the high court that Mathibela’s arrest was violating his human rights. In the mean time Vusi is waiting on Judgement of his arrest after he abandoned bail. Mathibela’s co-accused had been given R25000 bail each for being involved in allegedly intimidating Mamelodi business people including taxi operators who were forced to pay protection fee. Annelise van den Heever, who was representing Vusi in court said that he could have obtained his bail if he chose to. However, he chose to challenge his arrest as he believes that his arrest was unlawful. She raised a fact that Vusi’s arrest did not have a warrant of arrest or an affidavit required by law. She also mentioned that her client was taken to Mamelodi by police and added that his house was searched illegally but when he tried to bring the matter of his arrest to the attention of the magistrate’s court, he was told to take his complaint to a civil rights court.
